Course description

Module 3 – Mediation Theory & Practice

To enable the candidate to demonstrate a robust academic knowledge of an area of mediation of interest to them This module is mandatory for all candidates wishing to become a Fellow through the mediation pathway and comprises of two parts.  The first is the completion of an extended essay on one aspect of mediation theory.  The word count is between 6000-7000 words and must be completed within 6 months of receiving written formal approval.   The second part is a practice portfolio based on 3 mediations as an observer and 3 mediations as lead mediator

Suitability - Who should attend?

In order to register onto the Module, candidates must:

  • be registered with CIArb as a Mediation Member and have passed (or be exempt from) Module 2 Law of Obligations (Contract and Tort).

English Language Competence - CIArb training and assessment is carried out in English it is therefore essential that candidates are proficient in both written and spoken English.  Where English is not a candidate’s first language it is recommended that they have achieved a standard that is, as a minimum, equivalent to the International English Language Testing System (IELTS) level 7 or a score of 94-101 in the Test of English as a Foreign Language (TOEFL) system. CIArb issues this advice as a guideline and, while it will not require any evidence of this standard prior to enrolment on a course, candidates who do not have this standard of English may be disadvantaged.

Outcome / Qualification etc.

By the end of this module the learner will be able to:

  1. A) demonstrate enhanced skills in research including use of academic sources and correct legal citation, where appropriate
  2. B) Demonstrate that they can practical mediation skills in the context of co-mediation or observation
  3. C) Demonstrate an ability to enhance their mediation practice skills through a process of reflection
  4. D) Describe and explain the importance of a range of mediation skills and techniques to the effectiveness of a mediation

On successful completion of this course, candidates:

  • will be awarded a Diploma.
  • will be able apply to attend a Peer Interview (Mediation).

On successful completion of the Peer Interview, candidates:

  • will be eligible to upgrade to Fellow of CIArb and continue to enjoy a range of educational and professional benefits.

Expenses

The course fee is £550 + VAT.  The fee includes registration on the module and the first attempt at the extended essay.  Any fees charged by your mentor are in addition to the above fee and payable by yourself. Candidates are advised to refer to the fee sheet, which details other fees that may be relevant.
